2. ACCEPTANCE OF TERMS AND CONDITIONS
The Administrator offers you free access to and use of the online store, subject to your acceptance of these Terms and Conditions. By accessing, using, obtaining, or purchasing any product, content, data, materials, information, or services through our online store, you agree to comply with these Terms and Conditions. The Administrator reserves the right to add or modify any information on the online store without prior notice to site users.
3. WEBSITE CONTENT. ART FLAME’S LIABILITY REGARDING INFORMATION PRESENTED ON THE SITE. INTELLECTUAL PROPERTY RIGHTS
The Visitor/Buyer understands the concept of intellectual property and shall not download or use the content of the online store www.artflame.ro, including images, descriptions, graphic elements, without the written consent of the Administrator, as they represent the Administrator’s property and are protected by copyright law and laws regarding intellectual and industrial property.
Art Flame cannot and shall not be held liable for any damages caused by erroneous information regarding product and service characteristics that may appear on the site. These may include (but are not limited to): unintentional presentation of incorrect product dimensions, differences in product color on the website compared to the actual product in the box, etc. If you have purchased a product or service in such a situation, Art Flame offers you the possibility to immediately return the product and will refund all amounts paid, including those related to the return. Please note that all provisions in the Return Policy section will still apply.
The product images on the website may show some differences compared to the delivered products. This may occur due to minor updates or changes made to the product that are not yet reflected in the images.
Art Flame reserves the right to suspend announced promotions for a certain period if it finds itself unable to fulfill the respective orders.
The products sold on the site are intended for personal use only, and their resale is strictly prohibited without a distribution agreement with the Supplier.
4. CONCLUSION OF THE DISTANCE CONTRACT AND VALIDITY
By placing an order through the online store www.artflame.ro, the Buyer agrees to communication via email or phone, through which the Administrator conducts their activity. This distance contract enters into force upon confirmation of the order by the Administrator.
Confirmation is done verbally (by phone) or electronically (via email). The Terms and Conditions of the online store www.artflame.ro form the basis of the contract thus concluded.
The Administrator does not, under any circumstances, consider an unconfirmed order as having the value of a Contract.
The Buyer becomes the owner of the goods after payment is confirmed in the case of payment via bank transfer or card, or after making the payment and signing the transport documents in the case of delivery by courier with cash on delivery.
If the Administrator finds that they are or will be unable to fulfill an order, they will immediately notify the client and unilaterally cancel the respective order.
In certain cases where the Administrator finds they cannot fulfill the order, Art Flame may propose products or services similar to those ordered by the Buyer. In all such situations, the Buyer must give their consent before substitute products are delivered.
5. PRICES, PAYMENT METHODS AND INVOICING
Prices are displayed on the dedicated page of each product, include VAT, and also include delivery costs if this is explicitly stated or offered as a bonus for large orders. If the price is not displayed or is listed as zero, you will have the option to request an offer, and an operator will communicate the price to you as soon as possible. Art Flame does its best to ensure price accuracy on the site. However, if we find that some prices are incorrectly displayed and do not match the current price list, we reserve the unilateral right to cancel and not deliver orders placed for products with pricing errors. In all such cases, we will inform the Buyer via phone and email about the situation.
The price of the ordered product is the one displayed at the time the order is placed.
The price printed on the invoice is the same as the one communicated by the operators at the time of order confirmation.
The prices of products in the online store www.artflame.ro may differ from those in physical stores.
Orders on the website www.artflame.ro can be placed using the following payment methods:
Cash on delivery,
Bank card at the time of order placement,
Bank transfer after issuing the pro forma invoice.
For orders paid by cash on delivery or by bank card at the time of placing the order, the ordered products are automatically reserved.
Based on the information held by www.artflame.ro and those provided by the Buyer, an invoice will be issued for the delivered goods.
Additionally, the package will be accompanied by the legally required documentation for the ordered product(s), as applicable: warranty certificate, user manual, certificate/declaration of conformity, etc.
6. WORKING HOURS, DELIVERIES AND DEADLINES
Orders can be placed at any time, but processing takes place from Monday to Friday between 8:00 AM and 4:00 PM, excluding public holidays. During this time frame, an Art Flame operator will review and process the order within 24 hours of placement.
Products available in the online store can be delivered either by Art Flame SRL’s fleet within the specified delivery area or by courier services.
The delivery time for products is 48–72 hours from the moment delivery is confirmed.
During peak periods (such as Black Friday or the days leading up to major public holidays, but not limited to these), the processing and delivery times may increase and differ significantly from the standard time mentioned on the website.
Physical deliveries are made door-to-door (free delivery refers to delivery from the Art Flame warehouse to the front door of the customer's building. In the case of apartment buildings, the “front door” is understood to be the main entrance at ground level), via express courier services. For locations outside the distribution area of the Art Flame fleet, deliveries are made by FanCourier—an outsourced service, and thus independent of the Administrator. Delivery delays beyond the originally confirmed time may occur; in such cases, the Administrator does not assume any liability on behalf of the courier companies.
Additionally, delivery is free provided the customer accepts the standard delivery option offered by Art Flame. If the customer chooses a different delivery method than the standard free one specified on the website at the time of order, the customer will bear the additional transport costs incurred by that delivery.
The Administrator assumes responsibility for the delivery of products ordered by the Buyer. The risk of loss of goods transfers to the Buyer at the moment of actual delivery.
7. STOCK AVAILABILITY
Products are available in stock. The Seller does not guarantee the availability of the products displayed, and therefore reserves the right not to deliver part or all of an order if certain products are no longer part of the current offer or are out of stock. Customers will be correctly informed, in accordance with the Terms and Conditions, about the availability of ordered products before the delivery is confirmed. Rarely, communication errors may occur in this regard.
8. WARRANTIES
Art Flame SRL guarantees that the delivered products are original, sealed (as received from partners), and accompanied by the fiscal invoice, receipt (issued by the Administrator or the courier company), and, where applicable, a warranty certificate (for products that require a warranty).
We declare on our own responsibility, in accordance with Article 5 of Government Decision no. 1022/2002 on the regime of products that may endanger life and health, occupational safety, and environmental protection, that the delivered products do not endanger life, health, occupational safety, do not have a negative environmental impact, and comply with: EC Directives 67/549/EEC and 1999/45/EC (provided that handling, transport, and storage instructions from the Technical Data Sheets and Safety Data Sheets issued by the supplier are respected, available in original at the company headquarters and on the website www.artflame.ro on the relevant product pages).
The products sold are guaranteed for the period specified on the packaging, provided that storage and transport instructions are followed.

9. INFORMATION REGARDING THE EXERCISE OF THE RIGHT OF WITHDRAWAL
These provisions are supplemented by Law 365/2002 on electronic commerce, republished and amended, and by Government Emergency Ordinance (GEO) 34/2014 on consumer rights in contracts concluded with professionals.
Return Policy
In accordance with GEO 34/2014, you have the right to withdraw from this contract without giving any reason and without incurring penalties within 14 calendar days. The withdrawal period expires 14 calendar days from the day on which you or a third party other than the carrier, indicated by you, takes physical possession of the products.

To meet the withdrawal deadline, it is sufficient to send your communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw, we will refund all payments received from you, excluding any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us, without undue delay and in any case no later than 14 days from the date we are informed of your decision to withdraw from this contract.
Additional costs include any expenses (transport, delivery, diminished product value due to handling beyond what is necessary to determine the nature, characteristics, and functioning of the goods, postage or other fees) that will be borne by the consumer when exercising the right of withdrawal. Courier service costs are non-refundable.
Standard delivery is considered the free delivery offered by the Art Flame fleet for orders over 5000 RON.
We will carry out the reimbursement using the same payment method used for the original transaction, unless you have expressly agreed to a different method; in any case, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or until you have supplied proof of having sent back the goods, whichever is earlier.
If you have received goods related to the contract, you must send them back or hand them over to us at any of the locations listed on the contact page of www.artflame.ro without undue delay and in any event no later than 14 days from the date on which you informed us of your withdrawal. The deadline is met if the goods are sent back before the 14-day period has expired.
The right of withdrawal applies only to individual consumers as defined in Art. 2, point 1 of GEO 34/2014.
You will bear the direct cost of returning the goods. The consumer is responsible for the integrity of the product until it is received by the store. The estimated cost is approximately 10 RON/kg.
You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to determine the nature, characteristics, and functioning of the goods.
At the request and with the agreement of the consumer, Art Flame SRL may recommend the purchase of another product of equivalent quality and price to the one in the original order. The initial order will be canceled on the date the replacement product(s) are confirmed.
If you are considering returning a product, do not use it!
You cannot use the products you have received before making a decision regarding the cancellation of the sales contract. The right of withdrawal exists to allow you to examine the product as you would in a physical store—not to provide you with 14 days of free use.
Products that cannot be returned include those that:
Were part of a special order
Were customized at the consumer’s request
Were manufactured to the consumer’s specifications (e.g., color adjusted as requested)
Show signs of damage, wear, or deterioration
Have been unsealed and no longer have intact original packaging, including all accessories and labels
Have been altered in any way that renders them unsuitable for resale
For products picked up directly by the Buyer from the store, since the Buyer has the opportunity to inspect the product in person, the return conditions described in this section do not apply.
If the ordered product was delivered together with gift items, these must also be returned. Otherwise, your return may be refused or the value of the gift items will be deducted from the refund. Gift items delivered with the main product are subject to the same return conditions as the main product.
Art Flame SRL will bear the cost of return if it is attributable to them (e.g., the wrong product was delivered, or the delivered product does not match the order).

10. BUYER’S OBLIGATIONS
To provide real, correct, and up-to-date information about their entity when requested; otherwise, orders may be refused.
To accept the resolution of any potential issues within 30 days from the date of notification, by sending an email to the Administrator.
To accept the Terms and Conditions of the Administrator upon placing orders and to pay the value of the goods using the available payment methods at the time of order submission.
11. SELLER’S OBLIGATIONS
To provide users with free professional information about its products and services. The content published in the online store is for informational purposes only. Product characteristics and related technical documentation displayed on the site are provided by manufacturers and suppliers. Product images are for presentation purposes. Depending on the batch in which they were manufactured, the actual appearance of the product may differ.

To deliver products within a maximum of 30 days from delivery confirmation, provided they are in stock.
To use the personal data collected from customers/users in accordance with the Privacy Policy section, which is an integral part of the Terms and Conditions.

13. DISPUTES
These Terms and Conditions are governed by Romanian law. In the event of a dispute, if an amicable resolution is not achieved after the complaint has been registered with the company, the matter will be settled in court at the Iași Tribunal.
Art Flame is not liable for damages caused without its fault, including those resulting from the malfunctioning of the online store or the inability to access its web pages (e.g., internet network failures).
Force majeure exempts the party invoking it from liability.
